Australian Academy of Artificial Intelligence (AAAI) — Terms of Service

1. Overview

This website and learning platform are operated by the Australian Academy of Artificial Intelligence (AAAI) in partnership with Thinkific Labs Inc. (“Thinkific”), our learning management system provider. Throughout these Terms, the terms “we”, “us” and “our” refer to AAAI.

By visiting our site, enrolling in a course, or purchasing services from us, you engage in our “Services” and agree to be bound by these Terms of Service (“Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink.

These Terms apply to all users of the site, including browsers, customers, students, organisations, and contributors of content.

2. Password Use and Security

Training is for your exclusive use only. Use or sharing of your username and password by another user is not permitted and is cause for immediate termination of this agreement without notice.

You are solely responsible for maintaining the confidentiality of your username and password and for all activities that occur under them. AAAI is not liable for any misuse due to third-party activity or your failure to maintain confidentiality.

3. Eligibility

By agreeing to these Terms, you represent that you are:

  • At least 16 years of age, or using the Services with the consent of a parent or guardian if under 18.
  • Legally able to enter into a binding contract in your jurisdiction.

Organisations enrolling staff warrant that they have the authority to bind the organisation to these Terms.

4. Use of Services

You may not use our Services for unlawful purposes, including infringement of intellectual property, breach of confidentiality, or violation of Australian law. You must not introduce malicious code or attempt to interfere with the Services.

All course licences are personal, non-transferable, and revocable. Copying, reselling, distributing, or exploiting content requires written permission from AAAI.

Thinkific’s platform terms of use apply in addition to these Terms.

5. Payments, GST, and Refunds

All fees are in AUD and inclusive of GST unless stated otherwise. Payments are processed securely via third-party providers (e.g., Stripe, PayPal). By providing payment information, you authorise AAAI (and providers) to process charges for enrolments.

Under the Australian Consumer Law (ACL), you are entitled to a remedy if services fail consumer guarantees. Beyond these statutory rights, sales are final unless explicitly stated in writing. Corporate agreements may include separate refund or cancellation terms.

6. Intellectual Property

All course content, resources, and frameworks are the property of AAAI or our licensors and are protected by Australian copyright law. You are granted a limited, personal, non-exclusive licence for educational use. Reproduction, resale, or redistribution requires written permission.

7. Credentialing and Certification

Certificates are issued via credentialing partners (e.g., Sertifier). Certification requires successful completion of all requirements, including proctored exams. AAAI may revoke or withhold certification for fraud, breach of proctoring conditions, or misrepresentation.

8. Corporate and Enterprise Use

Organisations must ensure compliance with these Terms. Enterprise agreements may include additional conditions (e.g., data security, delivery methods, confidentiality), which take precedence over general Terms for that client.

9. Third-Party Services

Our Services may include third-party tools (Thinkific, payment processors, AI tutoring platforms, credentialing providers). We are not responsible for third-party services, which are governed by their own terms.

10. Privacy and Data Protection

Your information is handled per the AAAI Privacy Policy and in compliance with the Privacy Act 1988 (Cth) and Australian Privacy Principles. By using our Services, you consent to collection, storage, and overseas transfers of personal data where applicable.

11. Accuracy of Information

We make reasonable efforts to ensure accuracy, but are not liable for outdated, incomplete, or inaccurate information. Use of such information is at your own risk.

12. Modifications to Services and Pricing

We reserve the right to modify or discontinue Services, or adjust pricing, at any time without notice. Statutory rights under the ACL remain unaffected.

13. Warranties and Liability

Services are provided “as is” and “as available”. We do not warrant uninterrupted or error-free Services. To the maximum extent permitted by law, liability is limited to resupplying Services or refunding costs, as required by the ACL. We are not liable for indirect or consequential loss.

14. Indemnity

You agree to indemnify AAAI, its affiliates, staff, contractors, and partners against claims arising from misuse of Services, breach of Terms, or violation of law/third-party rights.

15. Termination

We may suspend or terminate your access for breach of these Terms. You remain responsible for fees incurred prior to termination. You may cease use and notify us in writing to terminate at any time.

16. Governing Law

These Terms are governed by the laws of Victoria, Australia. Disputes are subject to the exclusive jurisdiction of Victorian courts.

17. Changes to Terms

We may amend these Terms at any time. Updates will be posted on our website. Continued use constitutes acceptance of revised Terms.
